Terms of Use

These Terms govern your use of leasebirmingham.com. They are a binding agreement between you and Lease Birmingham LLC. Read them before using this website, submitting information, or relying on any tool or estimate published here.

Read Section 12 carefully. It requires most disputes to be resolved through binding individual arbitration and waives your right to participate in a class action or a jury trial. By using this website you accept that provision.
Section 01

Agreement to These Terms

This website is operated by Lease Birmingham LLC, an Alabama limited liability company ("Lease Birmingham," "we," "us," or "our"). By accessing leasebirmingham.com, any subdomain, or any page, form, tool, calculator, listing, or feature made available on it (collectively, the "Site"), you agree to these Terms of Use and to our Privacy Policy, which is incorporated here by reference.

If you do not agree to these Terms, do not use the Site. Your continued use after any change to these Terms constitutes acceptance of the revised version.

You must be at least eighteen years of age and legally able to enter a binding contract in order to use the Site or submit information through it.

Section 02

What This Site Is and What It Is Not

The Site provides general information about the property management services Lease Birmingham offers to owners of single-family, multi-family, and Section 8 rental property in the Birmingham metropolitan area.

The Site does not create a management relationship. Lease Birmingham does not manage your property, and owes you no management, fiduciary, or agency duty, unless and until a written management agreement is signed by both parties. Submitting a form, requesting a rental review, calling the office, or exchanging correspondence does not create that relationship and does not obligate Lease Birmingham to accept a property.

Nothing on the Site is legal, tax, accounting, investment, appraisal, or financial advice. Content on the Site is general in nature and does not account for your property, your lease, your tenant, your financing, or your circumstances. Consult a licensed attorney, accountant, or financial professional before acting on anything published here.

Lease Birmingham LLC is licensed by the Alabama Real Estate Commission, AREC Company License 000173426. Licensure does not create a duty to any Site visitor absent a signed agreement.

Section 03

Cash-Flow Estimators and Calculators

The Site publishes cash-flow estimators and similar interactive tools. These tools are decision-support illustrations only. They perform arithmetic on figures you enter and produce a hypothetical result.

You acknowledge and agree that:

  • No estimate produced by any tool on the Site is a projection, forecast, appraisal, valuation, guarantee, promise, or representation of actual or future performance.
  • Results depend entirely on the accuracy of the information you enter. Incorrect, incomplete, outdated, or optimistic inputs produce an inaccurate result.
  • Vacancy, nonpayment of rent, eviction costs, unplanned repairs, capital expenditures, tax increases, insurance increases, utility changes, association assessments, financing costs, changes in rental demand, regulatory changes, and casualty losses can materially change actual results.
  • Actual performance of any property will differ, and may differ substantially and unfavorably, from any estimate generated on the Site.
  • No financial result of any kind is guaranteed.

Do not make a purchase, sale, financing, refinancing, management, or investment decision in reliance on any estimate produced by this Site. Lease Birmingham accepts no liability for any decision made in reliance on these tools.

Section 04

Property Listings and Availability

Rental listings displayed on the Site are drawn from Lease Birmingham's property management system and are provided for informational purposes only. Listings are synchronized periodically and may not reflect the current status of a property at the moment you view it.

Lease Birmingham does not warrant that any listing is accurate, complete, or current. Rent amounts, availability dates, deposits, square footage, bedroom and bathroom counts, photographs, floor plans, descriptions, amenities, pet policies, and school or neighborhood information are subject to change, error, and omission without notice. A property shown as available may already be leased, withdrawn, or under application.

No listing constitutes an offer to lease. All rental applications are subject to Lease Birmingham's screening criteria, availability at the time of application, owner approval, and execution of a written lease. Photographs may depict a similar unit rather than the specific unit advertised.

Lease Birmingham complies with the federal Fair Housing Act, the Alabama Fair Housing Law, and all applicable state and local fair housing requirements. We do not discriminate on the basis of race, color, national origin, religion, sex, familial status, or disability.

Section 05

Rental Reviews, Forms, and Information You Submit

The Site offers forms through which you may request a rental review, request contact, join a waitlist, or otherwise submit information. By submitting any form you represent that the information you provide is truthful, accurate, and complete, and that you are authorized to submit it.

No obligation created

Submitting a form does not obligate Lease Birmingham to review your property, respond within any timeframe, offer services, quote a fee, accept a property for management, approve a rental application, or enter into any agreement. Lease Birmingham may decline any submission for any lawful reason.

No confidential or sensitive material

Do not submit confidential, privileged, or sensitive material through the Site. Do not upload or transmit leases, inspection reports, repair estimates, financial statements, tax records, Social Security numbers, bank or payment card information, government identification numbers, or tenant records through Site forms. Information transmitted over the internet is not guaranteed to be secure, and no submission through the Site is treated as confidential or privileged.

Consent to be contacted

Where you check a consent box, you authorize Lease Birmingham to contact you by telephone, text message, and email at the contact information you provide, including through automated means, regarding your submission and our services. Message and data rates may apply. You may withdraw consent at any time by replying STOP to a text message, using the unsubscribe link in an email, or contacting our office directly. Withdrawal of consent does not affect communications necessary to an existing contractual relationship.

License to use your submission

You grant Lease Birmingham a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and process any information you submit for the purpose of evaluating your request, responding to you, providing services, and maintaining business records, subject to our Privacy Policy.

Section 06

Owner and Tenant Portals

Lease Birmingham provides owner and tenant portal access through Rentvine, a third-party property management platform. Portal access is a convenience offered to current clients and tenants and is governed by these Terms together with any terms, policies, or agreements imposed by the platform provider.

By using a portal you agree that:

  • You will keep your credentials confidential and will not share, sell, or transfer them.
  • You are responsible for all activity occurring under your credentials, whether or not authorized by you.
  • You will notify Lease Birmingham immediately of any suspected unauthorized access.
  • You will not attempt to access any account, record, statement, work order, ledger, or document that does not belong to you.
  • Portal availability is not guaranteed and may be interrupted for maintenance, upgrades, provider outages, or reasons outside our control.
  • Statements, ledgers, work orders, and reporting shown in a portal may reflect pending or unposted transactions and are subject to reconciliation and correction.

Lease Birmingham does not control the third-party platform and is not responsible for its performance, availability, security, data handling, or terms. Access may be suspended or terminated at any time, including on termination of the underlying management agreement or lease.

Section 07

Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law, including fair housing, consumer protection, and anti-discrimination laws.
  • Submit false, fraudulent, misleading, or impersonating information through any form.
  • Scrape, crawl, harvest, mine, or use automated means to extract data, listings, images, or contact information from the Site.
  • Attempt to gain unauthorized access to the Site, any portal, any account, any server, or any connected system.
  • Introduce malware, viruses, or any code intended to disrupt, damage, disable, or overburden the Site.
  • Interfere with the operation of the Site or with any other party's use of it, including through denial-of-service activity or excessive automated requests.
  • Reproduce, republish, distribute, resell, or create derivative works from Site content without prior written permission.
  • Frame, mirror, or use the Site's trademarks or branding in a manner suggesting affiliation, sponsorship, or endorsement that does not exist.
  • Post or transmit content that is defamatory, harassing, threatening, obscene, or that infringes the rights of any third party.

Lease Birmingham may investigate suspected violations, block access, refuse service, and refer matters to law enforcement, in each case without notice and without liability.

Section 08

Intellectual Property

All content on the Site, including text, articles, page copy, calculators and their underlying logic, layout, design, graphics, photographs, illustrations, icons, and compilations, is owned by Lease Birmingham LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property law.

"Lease Birmingham," the Lease Birmingham logo, and related marks are trademarks of Lease Birmingham LLC. Nothing on the Site grants any license or right to use them.

You may view, download, and print Site content for your own personal, non-commercial reference, provided you do not remove any copyright or proprietary notice. All other use requires prior written permission.

If you believe content on the Site infringes your copyright, send written notice to the mailing address in Section 15 identifying the work, the material claimed to infringe, and your contact information, together with a statement of good-faith belief and a statement of accuracy made under penalty of perjury.

Section 09

Third-Party Links and Services

The Site links to and integrates third-party websites and services, including the Rentvine portal platform, Google Maps, Google Reviews, and social media platforms. These are provided for convenience only.

Lease Birmingham does not control, endorse, monitor, or assume responsibility for any third-party site, service, content, product, privacy practice, or security practice. Your use of any third-party service is governed by that party's terms and privacy policy and is at your own risk. Reviews and ratings published on third-party platforms are authored by third parties and are not statements of Lease Birmingham.

Section 10

Disclaimer of Warranties

The site and all content, tools, estimators, listings, forms, portals, and features made available on it are provided on an "as is" and "as available" basis, without warranty of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, Lease Birmingham LLC disclaims all warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

Lease Birmingham does not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site or its servers are free of harmful components; or that any content, listing, estimate, or calculation is accurate, complete, current, or reliable. Some jurisdictions do not permit the exclusion of certain warranties, so portions of this section may not apply to you.

Section 11

Limitation of Liability

To the fullest extent permitted by Alabama law, Lease Birmingham LLC and its members, managers, officers, employees, agents, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost rents, lost revenue, lost business opportunity, diminished property value, loss of data, or cost of substitute services, arising out of or related to your use of or inability to use the site, whether based in contract, tort, negligence, strict liability, statute, or any other theory, and whether or not Lease Birmingham was advised of the possibility of such damages.

Lease Birmingham's total aggregate liability for all claims arising out of or related to the site shall not exceed one hundred United States dollars ($100.00).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or for willful misconduct. This section does not govern the parties' respective obligations under a signed property management agreement, which controls as to that relationship.

Section 12

Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and your right to a jury trial.

Agreement to arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site, including questions of its formation, interpretation, breach, termination, validity, enforceability, or scope, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, rather than in court.

Arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Jefferson County, Alabama, unless the parties agree otherwise or the arbitrator determines that a different location is required to avoid undue burden on a consumer party. This agreement to arbitrate is governed by the Federal Arbitration Act. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver

All claims must be brought in an individual capacity only. You and Lease Birmingham LLC each waive any right to bring, join, or participate in a class action, collective action, consolidated action, private attorney general action, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding.

If this class action waiver is found unenforceable as to a particular claim, that claim shall be severed and litigated in court while all remaining claims proceed in arbitration.

Exceptions

Either party may bring an individual action in small claims court for a dispute within that court's jurisdiction. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent unauthorized access to the Site. Nothing in this section prevents either party from reporting a matter to a government agency.

Right to opt out

You may opt out of this arbitration agreement by delivering written notice to Lease Birmingham LLC at the mailing address in Section 15 within thirty (30) days of the date you first use the Site. The notice must state your name, address, and an unambiguous statement that you decline to arbitrate. Opting out does not affect any other provision of these Terms.

Time limitation

Any claim arising out of or related to the Site must be filed within one (1) year after the claim accrues, or it is permanently barred, to the extent such limitation is permitted by applicable law.

Section 13

Indemnification

You agree to defend, indemnify, and hold harmless Lease Birmingham LLC and its members, managers, officers, employees, agents, contractors, and affiliates from and against any claim, demand, action, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or the rights of any third party, or any information you submit through the Site.

Section 14

General Provisions

Governing law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of laws principles. Subject to Section 12, the exclusive venue for any matter not subject to arbitration is the state or federal courts located in Jefferson County, Alabama, and you consent to personal jurisdiction there.

Changes to these Terms

Lease Birmingham may revise these Terms at any time by posting an updated version with a revised "Last Updated" date. Changes take effect on posting. Your continued use of the Site after posting constitutes acceptance. Review these Terms periodically.

Changes to the Site

Lease Birmingham may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice, and may restrict or terminate access without liability.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force and effect.

No waiver

Failure to enforce any provision is not a waiver of the right to enforce it later. No waiver is effective unless in writing and signed by an authorized representative of Lease Birmingham LLC.

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lease Birmingham LLC regarding the Site and supersede all prior understandings on that subject. Where you have signed a property management agreement, lease, or other written contract with Lease Birmingham, that contract controls as to its subject matter in the event of a conflict.

Assignment

You may not assign or transfer these Terms or any rights under them without prior written consent. Lease Birmingham may assign these Terms without restriction.

Survival

Sections 8, 10, 11, 12, 13, and 14 survive any termination of your use of the Site.
